The statement of claim is motivated by the fact that dd.mm.yyyy an employment contract was concluded between the parties, which was terminated dd.mm.yyyy under clause 3 of part 1 of Art. Labor Code of the Russian Federation.

During the period of work, dd.mm.yyyy, the defendant, working on an MTZ-82 tractor with a trailed ROTTINGER rake, exceeded the maximum speed limit established for the rake, did not reduce the speed when driving over bumps, which he could not help but see, as a result of which the fastening was broken gearbox and cardan shaft. As a result, one rake fell off, the rake's cardan shaft was lost, and the gearbox failed.

In accordance with the Labor Code of the Russian Federation CEO LLC "" R.Yu.P. demanded written explanations from the tractor driver regarding the breakage of the rake, but the defendant refused to give written explanations. Based on Part 2 of Art. LLC "" drew up a corresponding act.

To establish the amount of damage caused and the reasons for its occurrence, by order of the head of LLC "" dated dd.mm.yyyy, a commission was created that determined the cause of the damage - the deliberate actions of the defendant, who foresaw the possibility of the rake breaking, but was indifferent to this (indirect intent). The specified reason is reflected in the commission act dated dd.mm.yyyy

The commission was unable to determine the amount of damage caused, however, in accordance with Art. direct actual damage is 12,100 rubles and consists of the following: repair of the gearbox mounting - 5,100 rubles, purchase of a driveshaft - 7,000 rubles.

Average monthly wages the defendant during the period of work at LLC "" was 9755.53 rubles.

The article establishes that the financial liability of a party employment contract shall be for damage caused by it to the other party to this agreement as a result of its guilty unlawful behavior (actions or inaction), unless otherwise provided by this Code or other federal laws.

Each party to the employment contract is obliged to prove the amount of damage caused to it.

In paragraph 4 of the Resolution of the Plenum of the Supreme Court of the Russian Federation dated November 16, 2006 No. 52 “On the application by courts of legislation regulating the financial liability of employees for damage caused to the employer”, it is explained that the circumstances that are essential for the correct resolution of the case of compensation for damage by the employee, the obligation to prove which falls on the employer, in particular, includes: the absence of circumstances excluding the financial liability of the employee; illegality of behavior (actions or inactions) of the harm-doer; the employee’s guilt in causing the damage; a causal relationship between the employee’s behavior and the resulting damage; the presence of direct actual damage; the amount of damage caused.

According to Art. the employee is obliged to compensate the employer for direct actual damage caused to him.

Direct actual damage is understood as a real decrease in the employer’s available property or deterioration in the condition of said property (including property of third parties located at the employer, if the employer is responsible for the safety of this property), as well as the need for the employer to make costs or excessive payments for the acquisition, restoration of property or compensation for damage caused by the employee to third parties.

By virtue of Art. For damage caused, the employee bears financial liability within the limits of his average monthly earnings, unless otherwise provided by this Code or other federal laws.

According to the article, the full financial responsibility of the employee consists of his obligation to compensate the direct actual damage caused to the employer in full.

Financial liability in the full amount of damage caused may be assigned to the employee only in cases provided for by the Labor Code of the Russian Federation or other federal laws.

One of the above cases is clause 3, part 1, art. , according to which financial liability in the full amount of damage caused is assigned to the employee in the event of intentional damage.

Based on general legal norms, the employee’s intent to cause damage to the employer’s property is that the employee consciously committed actions aimed at causing direct actual damage to the employer, knew about the occurrence of such consequences and desired their occurrence or was indifferent to them. At the same time, to attract financial liability there must be a cause-and-effect relationship between the employee’s intentional actions and the employer’s consequences.

According to Art. Before making a decision on compensation for damage by specific employees, the employer is obliged to conduct an inspection to establish the amount of damage caused and the reasons for its occurrence. To conduct such a check, the employer has the right to create a commission with the participation of relevant specialists.

Requiring a written explanation from the employee to establish the cause of the damage is mandatory. In case of refusal or evasion of the employee from providing the specified explanation, a corresponding act is drawn up.

The employee and (or) his representative have the right to familiarize himself with all inspection materials and appeal them in the manner established by this Code.

The plaintiff's arguments about the presence of intent on the part of the defendant are based on an act establishing the amount of damage caused and the reasons for its occurrence from dd.mm.yyyy. However, this act in itself does not unconditionally prove the fact of intentional damage caused by the employee and the amount of damage caused. The commission consisted of a chief accountant and an o/c inspector who did not have special knowledge in the field of technology. In addition, it is unclear from the report on what data the commission came to such conclusions (there is no inspection report of the tractor on the day of the breakdown, explanations from eyewitnesses, testimony from special technical means, instructions on the rules of working on a tractor with a rake, etc.), it has not been established at what speed the defendant was supposed to drive and actually drove the tractor during the work. Defendant Alekseev P.I. explained to the court that while working he was driving the tractor at a speed of about 10 km/h, which was permissible. After the rake broke, he took measures to repair it, but failed to weld the rake. After which the rake was transported by forklift to the garage of OOO "". The cardan shaft was on the tractor after the rake broke and was also taken to the garage. Witness T.T.V. confirmed the defendant's explanations.

In addition, the plaintiff has not proven the amount of damage caused. To justify the amount of damage, the plaintiff referred to invoice No. *** from dd.mm.yyyy and invoice No. *** from dd.mm.yyyy. At the same time, the need for such work and the purchase of a cardan shaft, which are causally related to the actions of the defendant , not proven. In addition, the plaintiff points to the breakdown of the ROTTINGER rake, while the company's fixed assets include a Eurotop 651A Multitast rake.

Under these circumstances, the court comes to the conclusion that there is no sufficient and reliable evidence confirming the unlawfulness of the behavior of employee P.I. Alekseev, his guilt in causing damage and the amount of damage caused.

In accordance with Art. The employee’s financial liability is excluded in cases of damage arising due to force majeure, normal economic risk, extreme necessity or necessary defense, or the employer’s failure to fulfill the obligation to provide adequate conditions for storing property entrusted to the employee.

Normal economic risk may include the actions of an employee that correspond to modern knowledge and experience, when the set goal could not be achieved otherwise, the employee properly fulfilled his official duties, showed a certain degree of care and prudence, took measures to prevent damage, and the object of risk was material assets, and not the life and health of people (clause 5 of the Resolution of the Plenum of the Supreme Court of the Russian Federation dated November 16, 2006 No. 52) .

Taking into account the above, the court comes to the conclusion that during the trial the circumstances with which Labor Code The Russian Federation binds the possibility of the onset of material liability of a party to an employment contract, namely, the culpable, unlawful behavior of the employee, or the causal relationship between the unlawful behavior of the defendant and the resulting damage has not been established. Under such circumstances, the grounds for satisfying the claims of LLC "" against P.I. Alekseev. There is no information about compensation for damages.
