Individual design does not create conditions for the organization of mass factory production of building structures and parts, which hinders the industrialization of construction. Typical projects provide for such technical solutions that provide the possibility of: putting into practice the construction of buildings and structures that are perfect in terms of functional, technical and economic qualities; the most efficient use of capital investments; widespread introduction of industrial construction methods; multiple use of projects in the construction of buildings and structures provided for by the national economic plan.

As a result of standard design, a fund of ready-made design documentation for capital construction is created. - A typical project consists of a set of working drawings with an explanatory note and an estimate. It contains data on the amount of work, the need for basic building materials, parts, structures and labor costs required for construction. Construction and installation work is carried out after "binding" standard projects to construction sites, and some of the drawings, if necessary, are specified in relation to the conditions of the construction site (terrain, type of soil, climatic conditions of the construction area, etc.).

A typical project is carried out by a design organization - a general designer - attracting, if necessary, specialized design organizations to perform individual work. Standard designs are developed mainly by head design institutes for the relevant industry, type of building, etc. Standard designs are drawn up on the basis of a program (design assignments) and are carried out in two stages - a design assignment and working drawings; when designing standard structures and parts, technical solutions are carried out and, on their basis, working drawings. For the wide involvement of specialists and in order to select the best solutions, competitions are held for the development of standard projects, a wide public discussion of projects and their coordination with interested organizations is carried out.

The massive use of standard designs in construction makes it possible to reduce the range of standard sizes of building structures and prefabricated parts due to the unification of space-planning and design solutions for industrial, residential and public buildings. Typical design in the field of housing construction has received especially great development, which made it possible to switch to industrial large-scale prefabricated construction from elements of industrial production and served as the basis for the development of a new type of construction - factory housing construction. The cost of construction of facilities built according to standard projects, as a rule, is 8-12% lower than the cost of similar facilities built according to individual projects.

The use of standard projects can significantly reduce the volume and timing of drawing up design and estimate documentation. New standard projects for the mass construction of public buildings meet modern requirements for health care, education, recreation, and consumer services. In order to ensure the integrated development of microdistricts, standard projects of residential buildings are developed in series, including various types of houses according to their purpose, number of storeys and plan sizes. Complex series are being developed more and more, including not only residential buildings, but also the main public buildings of the microdistrict network - schools, kindergartens, public and shopping centers.

The serial design method also contributes to the unification of structures and the improvement of the organization of work of construction industry enterprises that manufacture products (in accordance with approved catalogs of industrial building products) and house-building plants (producing sets of products for large-panel houses). Until 1955-56, standard designs of residential and public buildings provided for the use of load-bearing walls made of bricks, small stones and large blocks in combination with prefabricated reinforced concrete elements of foundations, ceilings, roofs, and stairs. Subsequently, the development of the industrial base of construction made it possible to move on to the standard design of a series of large-scale residential panel houses and individual types of public buildings. As a result of the experimental construction carried out, a wide range of frame-panel public buildings for various purposes with a unified grid of columns is being developed.

In experimental construction, which should be preceded by standard design, other types of residential buildings and public buildings are also tested, which are special in their purpose, layout, composition and construction (houses built by raising floors, houses from three-dimensional blocks, etc.). The development of standard projects of residential buildings and public buildings is carried out in accordance with the nomenclature of standard projects, which provides for the necessary types of buildings, their types in terms of capacity, number of storeys, layout features, structures. The nomenclature also takes into account the required number of series and individual projects for construction in various natural and climatic zones and in special geological conditions. When developing standard designs of production facilities, the use of high-performance units, the most progressive standards and production methods is envisaged. The basis of a typical design of a production facility is a carefully developed and proven technological process, taking into account the need to use the most rational equipment.

Typical projects for industrial construction are developed taking into account the established nomenclature of enterprises with optimal production capacities. This nomenclature provides for a minimum number of enterprises for various purposes and different capacities in a particular industry, which ensures the typing of equipment, its rational use, facilitates the unification of building solutions and helps to reduce specific capital investments. For industrial buildings, standard grids of columns and room heights, unified structural schemes and design loads are established. On the basis of these data, unified overall schemes of buildings for enterprises of various industries have been developed and approved.

In recent years, intersectoral unification of overall schemes has been carried out, which ensures a further reduction in the standard sizes of building products. In 1963-64, a transition was made to the design of industrial buildings from unified standard sections and spans using prefabricated structures. When developing projects using standard sections (standard spans), free blocking of production facilities into large buildings with a single internal space is provided. This design method can significantly increase the building density and ensure a wide unification of structures. Standard designs approved and put into effect in the prescribed manner are mandatory for use by all design and construction organizations and developer organizations in accordance with the scope established for them.

Standard designs are developed in accordance with the approved annual standard design plans. The plans provide for: standard designs of enterprises, buildings and structures of industry, transport, communications, agriculture, residential and public buildings; standard sections and standard spans for buildings of various industries; unified overall schemes, drawings of typical structures and parts, typical technological, energy, sanitary and other structures, devices and equipment; standard projects for the production of construction and installation works for mass construction projects and standard technological maps for the production of the main types of construction and installation works.

The expediency of including design work in a standard design plan must be justified by data on the expected frequency of use of the relevant design materials, based on long-term plans for the development of the national economy. With the development of new social forms of life and culture, the improvement of industrial production technology, construction equipment and the growth of material well-being, workers periodically change standard projects. The general management of standard design in the country is carried out by the State Construction Committee of the USSR, which approves the plan of standard designs for all types of construction, standard designs of the most important objects and standard designs for mass use in construction, as well as unified planning and design solutions for buildings and structures and drawings of standard structures and details . The Gosstroy of the USSR approves the lists of enterprises, buildings and structures of industry, transport and agriculture, the construction of which should be carried out only according to standard designs, as well as lists of existing standard projects.

For the purpose of continuous improvement of standard designs, design organizations that have developed standard designs or drawings of standard structures and parts study and generalize the practice of applying these projects, experience in the construction and operation of buildings and structures, as well as the manufacture and use of standard designs and parts; keep a record of the changes in standards, norms and design rules that have occurred during the period of validity of the relevant standard design materials, causing the need to adjust these materials, and promptly inform the higher (by subordination) organization, as well as the authority that approved the design materials, about the need to make changes to them. The current standard designs are periodically checked in relation to their compliance with the state of the art, norms, standards, rules of use.

This section presents the most successful design solutions implemented in our country over the past 10 years. Please note right away that ASP is not a developer of these projects, much less selling them as standard ones. Work on the systematization of these projects was carried out by the staff of the RASS, and the authors are a large number of design organizations in Russia (including ASP), which in different years were engaged in sports design.

The concept of "standard project" today has a rather vague interpretation, the ambiguity of understanding this term leads customers to unsatisfactory results. What is standard design documentation, does such a concept exist at the present time?

Before the entry into force of the Town Planning Code of the Russian Federation (until 01.01.2005), the concept of "standard project documentation", as well as the procedure for its development and use, were described in various regulatory and technical documents.

Until 2002, the composition and procedure for the development of standard design documentation was described in SN 227-82 "Instructions for standard design". Since 01/01/2002, SNiP 11-03-2001 "Standard design documentation" has been in force, replacing SN 227-82.

According to SNiP 11-03-2001, standard design documentation was described as space-planning solutions developed on the basis of unification and typing and included in the Federal Documentation Fund in Construction sets of documents for the creation of buildings and structures, structures, products and assemblies for multiple use in construction, containing text and graphic materials.

Typical design documentation, depending on the purpose, was divided into the following types:

Typical building structures, products and assemblies - for multiple use in design and construction, as well as in mass (batch) production and use at construction industry enterprises and construction sites;

Standard projects - for the construction of buildings and structures, binding to a specific construction site or for development individual projects;

Standard materials for design - for methodological support for the design of specific construction projects, binding of standard projects.

The decision to assign the status of "standard" to the developed design documentation was made by the Federal Agency for Architecture and Urban Planning.

The approved standard design documentation was to be included in the Standard Design Documentation Fund.

After the entry into force of the Town Planning Code of the Russian Federation, the order of the Ministry of Regional Development of the Russian Federation dated July 9, 2007 N 62 was adopted "On approval of the criteria for classifying project documentation as standard design documentation, as well as modified standard design documentation that does not affect the design and other characteristics of reliability and security of capital construction projects. The order gave a different definition of standard design documentation: "The re-applied design documentation of a capital construction object as part of the following sections (including all drawings, diagrams, etc.): architectural solutions; constructive and space-planning solutions, with the exception of decisions on foundations; information about engineering equipment, engineering and technical support networks, a list of engineering and technical measures, the content of technological solutions, with the exception of decisions on external engineering networks (hereinafter referred to as standard design documentation), as well as the applicable standard design documentation for a capital construction object, which includes changes that do not affect the characteristics of structures, elements of structural systems of a capital construction object, affecting the reliability of their work and the ability to maintain the operational qualities of a capital object construction during the service life of such an object (hereinafter referred to as the modified standard design documentation that does not affect the design and other characteristics of the reliability and safety of capital construction facilities) is developed in accordance with Article 48 of the Town Planning Code of the Russian Federation, taking into account the features established by this Regulation. Since the beginning of 2011, the concept of "standard design documentation" has also changed several times. In accordance with Decree of the Government of the Russian Federation N 145 dated March 05, 2007, project documentation for seven years from the date of receipt of the initial positive conclusion of the state examination until the date of filing an application for a state examination of the results of engineering surveys, "zero cycle and networks of engineering and technical support.

Finally, at the end of 2011, Decree of the Government of the Russian Federation N 791 dated September 27, 2011 "On the Formation of a Register of Standard Design Documentation and Amendments to Certain Decrees of the Russian Federation" was adopted, according to which project documentation that received a positive conclusion from the state examination of project documentation and re-applied.


Can the "old" standard project documentation be considered as relevant? Is it legal to apply the concept of "active" / "inactive" to standard design documentation?

At present, the status of standard design documentation is confirmed by the inclusion in the register of standard design documentation. The responsibility for maintaining the register is assigned to the Ministry of Regional Development of the Russian Federation.

The register "Federal Data Bank for the Design of Capital Construction Facilities and the Most Cost-Effective Reuse Projects" is posted on the official website of the Ministry of Regional Development of the Russian Federation:

The register, in particular, contains the materials of the "Catalogues of design documentation for reuse" compiled by JSC "CPP" and included in the information product "Techexpert: TPD. Buildings, structures, structures and components" in the form of catalog sheets / passports.

"Old" standard project documentation cannot currently be considered as "current", "active" or "inactive", from the date of entry By virtue of the Town Planning Code of the Russian Federation, it all automatically became a reference.


Is it possible to use the "old" standard design documentation in modern conditions when designing objects? Are there any peculiarities of passing the examination of projects when using the TPD? In what form should it be submitted for examination if it is part of a new project (structures, units)?

Currently, standard design documentation as such does not exist. There is an author's design documentation, the use of which is possible by third-party organizations if it has received a positive assessment of the state expertise and when concluding an agreement with the copyright holder.

In connection with changes in the regulatory framework (entry into force of technical regulations, gradual transition to technical regulation within the framework of the Customs Union), it must be remembered that the "old" standard design documentation can be used insofar as it does not contradict the requirements of technical regulations. Otherwise, the body of state construction supervision will subsequently be entitled to bring to administrative responsibility for deviations from the requirements of technical regulations. Standard design documentation developed after the entry into force of technical regulations can be used as consistent with current standards. For example, when building for public needs, it must be taken into account that any materials and equipment that will be used in this building must meet the requirements of the class energy efficiency"BUT". This is how the provisions of Article 13 of the technical regulation "On the safety of buildings and structures" are implemented. In the development of Article 6 of this technical regulation, the Decree of the Government of the Russian Federation dated 06/21/2010 N 1047-r "On approval of the list of standards, the application of which on a mandatory basis ensures the fulfillment of the requirements of the technical regulation" On the safety of buildings and structures ", was adopted.

In accordance with clause 15 of Decree of the Government of the Russian Federation of March 5, 2007 N 145, when using standard design documentation, it is mandatory to submit a document confirming the right to use it (for example, a license agreement), as well as a document confirming the compliance with climatic and other conditions in which the standard design documentation the documentation is planned for re-use, the conditions under which it was developed for the original use. The form of this document has not yet been established, it must be established by the Ministry of Regional Development. To apply the TPD, it is also necessary to submit foundations, engineering networks and engineering surveys for state expertise. This is necessary in order to "bind" project documentation to a specific construction site.

Please note that at the moment the main requirements for the design documentation are regulated by GOST R 21.1101-2009 (from 03/01/2009). It is mandatory by virtue of the order of the Government of the Russian Federation N 1047-r dated 06/21/2010. Thus, any methodological documents, including those related to the indicated lists, for example, MDS 11-9.2000, can be used to the extent that they do not contradict GOST R 21.1101-2009.

When using separate "standard products", for example, cable ladders of the NLK series, it must be remembered that these products do not fall under the category of "standard design documentation" in the current meaning. These components, products, parts can be used in project documentation if they comply with current standards, but, in addition to referring to a specific series, it would be correct to present a sheet from the corresponding album as part of the project documentation. If such a sheet is not issued in accordance with GOST R 21.1101-2009, then it must be issued in accordance with the requirements of GOST R 21.1101-2009.

Design documentation included in the author's catalogs (such as JSC "ROSEP", JSC "Russian Railways", etc.) can be used as a recommendation. At the same time, it must be remembered: if departmental requirements are softer than the norms of federal legislation, then it is necessary to use federal norms, if it is tougher, you can give preference to departmental standards. Mandatory will be departmental standards that are specified in the design contract, within the framework of Article 432 of the Civil Code of the Russian Federation or within the framework of the standards and rules of the SRO (Article 55.5 of the Civil Code of the Russian Federation), if their requirements do not contradict the norms of federal legislation. For example, in the Recommendations for the implementation of construction control on federal highways (ODM 218.7.001-2009), more stringent requirements for as-built documentation are given than in RD-11-02-2006, approved. by order of the Federal Service for Ecological, Technological and Nuclear Supervision of December 26, 2006 N 1128.

In connection with what is written above, when using a standard design document, one must not only understand whether it has the status of "standard", but also how much this project "fits" into the current legislation. The fundamental documents in this case are technical regulations, the Town Planning Code of the Russian Federation, the Decree of the Government of the Russian Federation N 1047-r of 06/21/2010, the Decree of the Government of the Russian Federation of 16.02.2008 N 87 "On the composition of sections of project documentation and requirements for their content", GOST R 21.1101- 2009.


Is it possible to use in the design of standard design documentation contained in electronic databases, such as, for example, in the system "Techexpert. TPD. Buildings, structures, structures and components"?

JSC "TsPP" (formerly CITP) for several decades has been maintaining the Federal Fund for Standard Design Documentation (TPD), which includes 7.5 thousand standard projects and 4.1 thousand issues of documentation of standard building structures, assemblies and parts, and publishes Indexes and Lists of standard design documentation of the all-Russian construction catalog. To date, there is the CK-3 Index, the SK-2 Index, the SK-2 Lists and the SK-11 List.

All these publications, especially Index SK-3, are unique. They are created on the basis of information provided by the developers of standard design documentation. This information formed the basis for the Techexpert : TPD product line, including Techexpert .TPD. Buildings, structures, structures and assemblies.

The use of standard design documentation included in the "Techexpert : TPD" product line is not only acceptable, but in some cases inevitable due to the lack of analogues in modern design. The old standard project documentation was created by the efforts of entire institutes and design organizations, its quality has been tested by time.

Thus, the product line "Techexpert : TPD" can be used in modern design, its use is allowed by the examination, but it is necessary to take into account the requirements of the current regulatory documents listed above. For example, the examination allows to attach to the set of design documentation a printout of any drawing of standard design documentation from the Techexpert: TPD product databases, provided that the drawing is drawn up in accordance with GOST R 21.1101-2009.

The Ministry of Regional Development has begun to form a register of reuse projects with in order to ensure the availability for all subjects of budget planning of projects for re-application and the introduction of mechanisms for the effective use of standard design documentation in the construction of social facilities and housing construction, the Ministry of Regional Development began to form a register of standard design documentation (based on Order No. 106 dated March 29, 2013 "On Approval Rules for the formation and maintenance of a register of standard project documentation, as well as the composition of information on project documentation that is subject to entry into the register, and the form of its submission ”, registered by the Ministry of Justice of Russia on July 31, 2013 - No. 29227), the press service of the Ministry of Regional Development reports.

Information about standard project documentation is included in the Register after their discussion and approval by the Regulatory and Technical Council for the selection of standard project documentation under the Ministry of Regional Development. The Council began its work in July this year.

At the same time, the Ministry of Regional Development sent requests to the Federal Autonomous Institution Glavgosexpertiza, NOSTROY and NOP to provide information about the available project documentation for inclusion in the register of standard project documentation.

The Register includes information on design documentation for residential and administrative buildings, social, cultural and public utility facilities (cultural, educational, healthcare facilities, sports buildings and facilities, etc.).

An engineering project developed with the participation of funds from the budgetary system of the Russian Federation or transferred free of charge for placement in the register of standard design documentation, with a mandatory positive expert opinion of state or non-state expertise, must be publicly available. This approach will ensure a reduction in the implementation time of projects in socially significant areas and reduce the costs of the budget system for their implementation,- Minister of Regional Development IN Slyunyaev outlined the position of the department.

Currently, the Register provides information on project documentation for 14 educational facilities (including 3 secondary schools and 11 kindergartens) and one healthcare facility (boarding home for the elderly with disabilities).

c) during the state examination of project documentation and engineering survey results, assessment of project documentation and engineering survey results for compliance with the requirements that were the subject of sanitary and epidemiological expertise, state environmental expertise, state historical and cultural expertise, state expertise of working conditions, state expertise in the field of protection of the population and territories from emergencies and industrial safety expertise is not carried out if, before the entry into force of the Regulation approved by this Decree, positive conclusions are obtained based on the results of these examinations, and also if positive conclusions based on the results of these examinations are obtained on the basis of materials sent for these examinations until January 1, 2007. The conclusions of these examinations are taken into account when preparing the conclusions of the state examination of project documentation and the results of engineering surveys;

d) state examinations of project documentation and engineering survey results that began before the entry into force of the Regulation approved by this resolution are subject to completion by the bodies (state institutions) that started them. Repeated state examinations of project documentation and engineering survey results may be carried out until January 1, 2008 by bodies (state institutions) that issued negative conclusions based on the results of primary state examinations;

e) a summary conclusion of the state examination of project documentation, issued before the entry into force of the Regulation approved by this resolution, and containing conclusions on the recommendation of the design documentation for approval, is equated to a positive conclusion of the state examination of project documentation and engineering survey results. The above summary conclusion, as well as a positive conclusion of the state examination of project documentation, issued in accordance with the Regulations approved by this resolution, before the acts of the Government of the Russian Federation provided for by subparagraph "a" of paragraph 3 and paragraph 4 of this resolution, and containing a positive assessment of the estimated cost, carried out in the cases specified in subparagraph "i" of this paragraph, in relation to a capital construction facility, the construction or reconstruction of which is financed in whole or in part at the expense of the federal budget, are equated to positive conclusions about the effectiveness, reliability and assessment of the validity of the use of federal budget funds allocated for capital investments;

f) prior to the approval of the requirements for the composition, content and procedure for issuing the conclusion of the state examination of project documentation and the results of engineering surveys, these conclusions are drawn up in any form;

g) project documentation, the development of which began before the entry into force of the approved by the Government of the Russian Federation Regulations on the composition of sections of project documentation and requirements for their content, during the state examination, it is checked for compliance with the composition and requirements for the content of the sections of this documentation, established by the regulatory technical requirements for its development (subparagraph as amended, entered into force on March 6, 2008 Decree of the Government of the Russian Federation of February 16, 2008 N 87 ;

h) before January 1, 2008, the conclusion of the state examination of project documentation and the results of engineering surveys is signed by the persons participating in this state examination;

i) until the entry into force of the act of the Government of the Russian Federation specified in subparagraph "a" of paragraph 3 of this resolution, the assessment of compliance of the estimated cost of a capital construction object, the construction or reconstruction of which is financed in whole or in part at the expense of the federal budget, with the standards in the field of estimated rationing and pricing is carried out simultaneously with the state examination of the design documentation of the corresponding capital construction object by the bodies (state institutions) that carry out this examination, and the conclusion of the state examination reflects the results of the assessment. There is no fee for this evaluation.

3. To the Ministry of Regional Development of the Russian Federation:

a) before May 1, 2007, submit in accordance with the established procedure a draft act of the Government of the Russian Federation regulating the procedure for verifying the reliability of determining in the project documentation the estimated cost of capital construction projects, the construction or reconstruction of which is financed in full or in part from the federal budget;

b) before June 1, 2007, submit in accordance with the established procedure a draft act of the Government of the Russian Federation regulating the composition and requirements for the content of sections: project documentation in relation to various types of capital construction projects, including linear facilities; design documentation in relation to individual stages of construction, reconstruction of capital construction projects; project documentation submitted for state expertise of project documentation;

c) before July 1, 2007, in agreement with the Ministry of Economic Development and Trade of the Russian Federation and the Ministry of Finance of the Russian Federation, submit proposals to the Government of the Russian Federation on improving the procedure for determining the amount of payment for the state examination of project documentation and engineering survey results;

d) within 3 months, approve the criteria for classifying design documentation as standard design documentation, as well as modified standard design documentation that does not affect the reliability and safety characteristics of capital construction projects.

4. By May 1, 2007, the Ministry of Economic Development and Trade of the Russian Federation shall submit, in accordance with the established procedure, a draft act of the Government of the Russian Federation regulating the procedure for conducting an audit and issuing conclusions on the effectiveness and assessment of the validity of the use of federal budget funds allocated for capital investments.

I. General provisions

1. This Regulation determines the procedure for organizing and conducting in the Russian Federation the state examination of project documentation and engineering survey results (hereinafter referred to as the state examination), the procedure for determining the amount of the fee for conducting the state examination, as well as the procedure for charging this fee. This Regulation is subject to application by all executive bodies authorized to conduct state expertise, state institutions and the State Atomic Energy Corporation "Rosatom", except for cases when a different procedure for conducting state expertise is established by the legislation of the Russian Federation for federal executive bodies and organizations authorized to conducting state expertise of federal laws and decrees of the President of the Russian Federation.

2. The concepts used in this Regulation mean the following: "applicant" - a technical customer, a developer or a person authorized by any of them who has applied for a state examination;

explain, free of charge, at the request of interested persons, the procedure for conducting state expertise; take measures to ensure the safety of documents submitted for the state examination, as well as non-disclosure of design decisions and other confidential information that became known to this organization in connection with the state examination.

4. The organization conducting the state examination is not entitled to participate in the implementation of architectural and construction design and (or) engineering surveys. * 4)

5. State expertise is carried out in the following cases:

a) design documentation and (or) engineering surveys have been completed in relation to capital construction facilities specified in parts 3_4 of article 49 of the Town Planning Code of the Russian Federation ;

b) there is a combination of the following circumstances: the conduct of state expertise or non-state expertise of project documentation and (or) the results of engineering surveys is mandatory; the developer or technical customer (hereinafter referred to as the applicant) has made a decision to conduct a state examination (except for the case specified in subparagraph "a" of this paragraph);

c) carrying out a state examination or non-state examination of project documentation and (or) the results of engineering surveys is not mandatory in accordance with parts 2, 3 and 3_1 of Article 49 of the Town Planning Code of the Russian Federation, however, the applicant made a decision to send the project documentation and (or) the results of engineering surveys for state expertise.

8. Examination of project documentation is not carried out in the following cases:

1) if construction or reconstruction does not require a building permit;

2) conducting such an examination in relation to the design documentation of capital construction objects that has received a positive conclusion from the state examination or non-state examination and is reused (hereinafter referred to as standard design documentation), or modification of such design documentation that does not affect the design and other characteristics of the reliability and safety of capital construction objects ;

3) if during the construction or reconstruction of a capital construction object, a modification of the design documentation is applied, including with respect to certain sections of the design documentation that previously received a positive conclusion from the state expertise, which does not reduce the design and other characteristics of the reliability and safety of capital construction objects;

4) in relation to sections of design documentation prepared for the overhaul of capital construction facilities, with the exception of project documentation prepared for the overhaul of public roads. If the construction of a capital construction facility will be carried out using standard design documentation or a modification of such design documentation, the results of engineering surveys are subject to state expertise, regardless of the fact that state expertise of project documentation is not carried out.

9. The powers of the state institution subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation include the organization and conduct of state expertise in relation to project documentation and (or) the results of engineering surveys prepared for the following types of capital construction objects (with the exception of objects located in administered by federal nuclear organizations):

a) objects, the construction or reconstruction of which is supposed to be carried out on the territories of 2 or more constituent entities of the Russian Federation, embassies, consulates and representative offices of the Russian Federation abroad;

b) objects, the construction or reconstruction of which is supposed to be carried out in the exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, in internal sea waters and in the territorial sea of ​​the Russian Federation;

c) objects of defense and security, other objects, information about which constitutes a state secret (with the exception of objects, state expertise in respect of which, by decrees of the President of the Russian Federation, is assigned to the powers of federal executive bodies);

d) objects of cultural heritage (monuments of history and culture) of federal significance in the event that the design and other characteristics of the reliability and safety of such objects are affected during the work on their preservation;

e) especially dangerous and technically complex facilities;

f) unique objects (with the exception of objects in respect of which the state expertise was assigned until 2017 to the authority of the Moscow executive authority);

j) objects of capital construction, the construction or reconstruction of which is financed with the attraction of funds from the federal budget (with the exception of objects, the state expertise in respect of which, by decrees of the President of the Russian Federation, is assigned to the powers of federal executive bodies).

12. State examination in respect of objects not specified in paragraph 9 of these Regulations, and objects, the state examination in respect of which is attributed by federal laws and decrees of the President of the Russian Federation to the powers of other federal executive bodies and organizations, is carried out by executive bodies authorized to conduct state examination. authorities of the constituent entities of the Russian Federation or state institutions subordinate to them at the location of the land plot on which it is planned to carry out construction, reconstruction and (or) major repairs of the capital construction object.

II. Submission of documents for state examination

13. For the state examination of both design documentation and the results of engineering surveys performed for the preparation of such design documentation, the following are submitted:

a) an application for a state examination, which indicates: identification information about the performers of the work - the persons who prepared the project documentation and performed engineering surveys (last name, first name, patronymic, details of identity documents, postal address of the place of residence of an individual entrepreneur, full name , location of the legal entity); identification information about the capital construction object, the design documentation and (or) the results of engineering surveys in respect of which are submitted for state expertise (name of the object (objects) of the proposed construction (reconstruction, overhaul), postal (construction) address of the capital construction object (objects), the main technical and economic indicators of the capital construction object (objects) (area, volume, length, number of floors, production capacity, etc.);

d) project documentation for a capital construction facility in accordance with the requirements (including the composition and content of sections of the documentation) established by the legislation of the Russian Federation;

e) a copy of the design assignment;

f) the results of engineering surveys in accordance with the requirements (including the composition of the specified results) established by the legislation of the Russian Federation;

g) a copy of the assignment for the performance of engineering surveys;

h) a positive conclusion of the state environmental review in the event that project documentation is submitted for the state review, developed in relation to capital construction facilities, the construction or reconstruction of which is supposed to be carried out in the exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, in internal sea waters or in the territorial sea of ​​the Russian Federation, as well as project documentation developed in relation to facilities related to the placement and disposal of waste of hazard classes I-V, artificial land plots on water bodies (except for cases when the applicant for state expertise submits project documentation developed in relation to facilities specified in subparagraph 7_1 of Article 11 and subparagraph 4_1 of Article 12 of the Federal Law "On Environmental Expertise");

i) documents confirming the applicant's authority to act on behalf of the developer, technical customer (if the applicant is not a technical customer and (or) developer), in which the authority to conclude, amend, execute, terminate the contract for the state examination (hereinafter - contract) must be specifically agreed upon;

j) a certified copy of a certificate issued by a self-regulatory organization on the admission of the work contractor to the relevant type of work on the preparation of project documentation and (or) engineering surveys, valid as of the date of signing the acceptance certificate for the work performed, and a copy of the acceptance certificate for the work performed if, in accordance with the law Russian Federation obtaining a permit for such work is mandatory.

14. For the state examination of the results of engineering surveys, before the design documentation is sent for state examination, the documents specified in subparagraphs "a" - "c" and "e" - "and" paragraph 13 of this Regulation, as well as a certified copy of the certificate issued by the self-regulatory organization on the admission of the work contractor to the corresponding type of engineering survey work, valid as of the date of signing the acceptance certificate for the work performed, and a copy of the acceptance certificate for the work performed, if, in accordance with the legislation of the Russian Federation, obtaining admission to such work is mandatory.

15. For the state examination of the results of engineering surveys in the cases specified in paragraph 8 of this Regulation, the documents specified in subparagraphs "a" and "e" - "i" are submitted paragraph 13 of this Regulation, as well as:

a) design documentation for external engineering networks and design solutions for foundations;

b) a positive conclusion of the state examination regarding the applicable standard design documentation (modified standard design documentation) issued to any person (subparagraph as amended; as amended Decree of the Government of the Russian Federation of September 27, 2011 N 791 ;

c) a document confirming the right of the developer (technical customer) to use standard design documentation, the exclusive right to which belongs to another person (an agreement on the alienation of an exclusive right, a license agreement, a sublicense agreement, etc.);

d) a document confirming the conformity of the climatic and other conditions in which the standard design documentation is planned for reuse, the conditions under which it was developed for initial use. The form of this document is approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation

e) if the application of standard project documentation requires the preparation of design documentation for external engineering networks and structural solutions of foundations, certified copies of a certificate issued by a self-regulatory organization on the admission of the performer of work to the corresponding type of work on engineering surveys and (or) certificate of admission of the performer of work to the relevant type of work on the preparation of project documentation in cases where, in accordance with the legislation of the Russian Federation, obtaining a permit for such work is mandatory. These certificates must be valid on the date of signing the act of acceptance of work performed. Simultaneously with copies of such certificates, a copy of the act of acceptance of the work performed is submitted.

16. For the state examination of project documentation after the state examination of the results of engineering surveys performed for the preparation of such project documentation, the documents specified in paragraph 13 of this Regulation(with the exception of a copy of the assignment for the performance of engineering surveys, as well as a certified copy of a certificate issued by a self-regulatory organization on the admission of the contractor to the corresponding type of engineering survey work), and a positive conclusion of the state examination of the results of engineering surveys, while the results of engineering surveys are not re-submitted.

17. The organization for conducting the state examination has the right to additionally demand from the applicant the submission of calculations of design and technological solutions used in the project documentation, as well as engineering survey materials. These calculations and materials must be submitted by the applicant within 5 days after receiving the relevant request. Requesting other information and documents from applicants is not allowed.

18. Documents referred to in paragraphs 13 - 16 of this Regulation, are submitted on paper or in the form of electronic documents using, among other things, the federal state information system "Unified Portal of State and Municipal Services (Functions)" (if there is an appropriate technical feasibility). Electronic documents submitted by the applicant must be signed with an enhanced qualified electronic signature. If the documents are submitted on paper, the contract for the state examination may provide that the project documentation and the results of engineering surveys may also be submitted in electronic form.

19. Design documentation for a capital construction facility may be submitted in relation to individual stages of construction, reconstruction of a capital construction facility.

20. If the project documentation and the results of engineering surveys are subject to state examination by the executive authorities of the constituent entities of the Russian Federation or state institutions subordinate to them, the documents necessary for the state examination are submitted to the organization for conducting the state examination of the constituent entity of the Russian Federation at the location of the land plot, on which it is supposed to carry out construction, reconstruction or overhaul of a capital construction facility. III. Verification of documents submitted for state examination

21. The organization for conducting the state examination within 3 working days from the date of receipt from the applicant of the documents specified in paragraphs 13 - 16 of this Regulation, checks them. The term for conducting an inspection in relation to the objects specified in paragraph 9 of this Regulation, should not exceed 10 business days (paragraph as amended Decree of the Government of the Russian Federation of December 29, 2007 N 970 .

22. At the time specified in paragraph 21 of this Regulation, the applicant is presented (sent) with a draft agreement with the calculation of the amount of the fee for the state examination, signed by the organization for the state examination, or a reasoned refusal to accept the documents submitted for the state examination, or these documents must be returned without consideration.

23. Documents submitted for the state examination shall be returned to the applicant without consideration on the following grounds:

a) state expertise must be carried out by another organization for conducting state expertise;

24. The grounds for refusal to accept the design documentation and (or) the results of engineering surveys submitted for state expertise are:

b) non-compliance of sections of the project documentation with the requirements for the content of the sections of the project documentation, established in accordance with;

c) non-compliance of the results of engineering surveys with the composition and form established in accordance with part 6 of article 47 of the Town Planning Code of the Russian Federation ;

d) submission of not all the documents specified in paragraphs 13 - 16 of this Regulation required for the state examination, including the absence of a positive conclusion of the state examination of the results of engineering surveys (in the event that the project documentation is sent for state examination after the state examination of the results of engineering surveys) (subparagraph as amended Decree of the Government of the Russian Federation of December 29, 2007 N 970 ;

f) performance of engineering surveys, the results of which are sent for state expertise, by a person who does not meet the requirements specified in parts 2 and 3 articles 47 of the Town Planning Code of the Russian Federation .

25. In case of return of the documents submitted for the state examination without consideration or refusal to accept the documents, the said documents shall be returned (with the exception of the application for the state examination) to the applicant.

If the shortcomings in the documents submitted by the applicant, which served as the basis for refusing to accept them for state examination, can be eliminated without returning these documents and the applicant does not insist on their return, the examination organization sets a time limit for eliminating such shortcomings, which should not exceed 30 days.

26. The legal regulation of the contract is carried out according to the rules established by the civil legislation of the Russian Federation in relation to the contract for the provision of services for compensation. The agreement defines:

a) the subject matter of the contract;

b) the term for the state examination and the procedure for its extension within the limits established Town Planning Code of the Russian Federation and this Regulation;

c) the amount of the fee for the state examination;

d) the procedure, permissible limits and terms for making changes to the project documentation and (or) the results of engineering surveys in the process of conducting state expertise;

e) the procedure and terms for the return to the applicant of the documents accepted for the state examination;

f) the terms of the contract, the violation of which refers to significant violations, giving the parties the right to raise the issue of its early termination;

g) liability of the parties for non-fulfillment and (or) improper fulfillment of obligations arising from the contract, including for late return or acceptance of documents submitted for state examination.

IV. Carrying out state expertise

27. The subject of the state examination of project documentation is the assessment of its compliance with the requirements of technical regulations, including sanitary and epidemiological, environmental requirements, the requirements of state protection of cultural heritage sites, the requirements of fire, industrial, nuclear, radiation and other safety, as well as the results of engineering surveys. The subject of the state examination of the results of engineering surveys is the assessment of their compliance with the requirements of technical regulations. All sections of the project documentation and (or) the results of engineering surveys, which, in accordance with the legislation of the Russian Federation, are submitted for state expertise, are subject to state expertise.

28. Conducting a state examination begins after the applicant submits documents confirming the payment for the state examination in accordance with the contract, and ends with the direction (delivery) of the conclusion of the state examination to the applicant.

29. The term for the state examination should not exceed 60 days. Within no more than 45 days, a state examination is carried out:

a) the results of engineering surveys that are sent for state expertise before the project documentation is sent for this expertise;

b) design documentation or design documentation and results of engineering surveys for residential capital construction projects, including those with built-in and attached non-residential premises that are not unique objects;

c) project documentation or project documentation and results of engineering surveys in respect of capital construction facilities, the construction, reconstruction and (or) major repairs of which will be carried out in special economic zones.

30. The legislation of the constituent entities of the Russian Federation may establish shorter periods for the state examination in respect of objects, the state examination of project documentation and (or) the results of engineering surveys for which is carried out by the executive authorities of the constituent entities of the Russian Federation or state institutions subordinate to them.

31. During the state examination of project documentation, prompt changes to the project documentation may be carried out in the manner prescribed by the contract.

32. When conducting a state examination, the organization for conducting a state examination shall have the right to:

a) demand from public authorities, local authorities and organizations information and documents necessary for the state examination;

b) engage on a contractual basis other state and (or) non-state organizations, as well as specialists, to conduct the state examination.

33. Bodies of state power, bodies of local self-government and organizations, no later than 10 days from the date of receipt of a written request from the organization for conducting state expertise to provide it with information and (or) documents necessary for conducting state expertise, send this organization the requested information and ( or) documents or notify in writing of the impossibility of submitting them, indicating the reasons.

V. The result of the state examination. Issue to the applicant of the conclusion of the state examination

34. The result of the state examination is a conclusion containing conclusions on compliance (positive opinion) or non-compliance (negative opinion):

a) project documentation results of engineering surveys that have received a positive conclusion from the state expertise, the requirements of technical regulations, including sanitary and epidemiological, environmental requirements, the requirements of the state protection of cultural heritage sites, the requirements of fire, industrial, nuclear, radiation and other safety, and the requirements for the content of sections of the project documentation, provided in accordance with part 13 of article 48 of the Town Planning Code of the Russian Federation, - in the event that the state examination of the project documentation was carried out after the state examination of the results of engineering surveys;

b) the results of engineering surveys to the requirements of technical regulations - in the event that a state examination of the results of engineering surveys was carried out;

c) design documentation for the results of engineering surveys, the requirements of technical regulations, including sanitary and epidemiological, environmental requirements, the requirements of state protection of cultural heritage sites, the requirements of fire, industrial, nuclear, radiation and other safety, and the requirements for the content of sections of design documentation provided for in accordance with part 13 of article 48 of the Town Planning Code of the Russian Federation, as well as the results of engineering surveys to the requirements of technical regulations - if the state examination of these project documentation and the results of engineering surveys was carried out simultaneously.

35. When design documentation and (or) results of engineering surveys are identified in the course of the state examination of deficiencies (lack (incomplete) of information, descriptions, calculations, drawings, diagrams, etc.) that do not allow drawing the conclusions specified in paragraph 34 of this Regulation, the organization for conducting the state examination shall immediately notify the applicant of the identified deficiencies and, if necessary, set a deadline for their elimination. If the identified deficiencies cannot be eliminated during the state examination or the applicant has not eliminated them within the prescribed period, the organization for conducting the state examination has the right to refuse further examination and raise the issue of early termination of the contract, of which it will notify the applicant in writing indicating the reasons for the decision.

36. The conclusion of the state examination is prepared and signed by persons certified for the right to prepare conclusions for the examination of design documentation and (or) the results of engineering surveys (hereinafter referred to as the expert) and participated in the conduct of the state examination, and is approved by the head of the organization for conducting the state examination or a person authorized by him. The expert conducts the state expertise and prepares the conclusion of the state expertise of the project documentation and (or) the results of engineering surveys in relation to those sections (subsections of sections) of the project documentation and (or) the results of engineering surveys that correspond to the direction (areas) of this expert's activity specified in the qualification certificate (qualification certificates).

37. The requirements for the composition, content and procedure for issuing the conclusion of the state examination are established by the Ministry of Construction and Housing and Communal Services of the Russian Federation.

38. Project documentation cannot be approved by the developer or technical customer if there is a negative conclusion of the state examination of the project documentation.

39. Issuance of the conclusion of the state examination is carried out in the hands of the applicant or by sending a registered letter. A positive conclusion of the state examination is issued in 4 copies. If the applicant sends documents for the state examination in electronic form, the issuance of the conclusion of the state examination is carried out in electronic form, unless another form of its issuance is indicated in the application and (or) contract.

41. The information contained in the register of issued state examination conclusions is open and provided to any person within 10 days from the date of receipt of a written request by the state examination organization. The procedure for maintaining the register of issued conclusions of the state examination and the provision of information contained in the register is established by the Ministry of Construction and Housing and Communal Services of the Russian Federation.

42. When conducting a state examination, a state examination file is opened. Cases of the state examination are archival documents of permanent storage. Their destruction, as well as the correction and (or) withdrawal of the documents contained in them are not allowed. The following shall be included in the state examination case:

a) applications for state examination (primary and repeated);

b) a copy of the contract;

c) documents containing conclusions made by organizations and (or) specialists involved on a contractual basis in the examination;

d) conclusions of the state expertise (primary and repeated);

e) other documents related to the conduct of the state examination (copies of documents) determined by the legislation of the Russian Federation and the organization for conducting the state examination.

43. In case of loss of the conclusion of the state examination, the applicant has the right to obtain a duplicate of this conclusion from the organization for conducting the state examination. Issuance of a duplicate is carried out free of charge within 10 days from the date of receipt of a written request by the specified organization.

VI. Repeated state examination

44. The project documentation and (or) the results of engineering surveys are sent again (2 or more times) for state expertise after the elimination of the shortcomings indicated in the negative conclusion of the state expertise, or when changes are made to the project documentation that received a positive conclusion from the state expertise, in part of the change technical solutions that affect the structural reliability and safety of the capital construction facility.

If the shortcomings that served as the basis for the negative conclusion of the state examination can be eliminated without returning these documents and the applicant does not insist on their return, the state examination organization sets a time limit for eliminating such shortcomings. In this case, the documents submitted for state examination shall not be returned to the applicant. After their completion, the applicant submits to the organization for the state examination a part of the design documentation and (or) the results of engineering surveys with the changes made and a certificate describing these changes.

45. An expert assessment during a repeated state examination is subject to a part of the design documentation and (or) the results of engineering surveys, in which changes have been made, as well as the compatibility of the changes made with the design documentation and (or) results of engineering surveys, in respect of which the state expertise. If, after the initial (previous repeated) state examination, changes are made to the legislation of the Russian Federation that may affect the results of the state examination, the submitted project documentation and (or) results of engineering surveys in full may be subjected to expert assessment.

57. When calculating, in accordance with this section, the amount of the fee for conducting a state examination, the amount of value added tax is taken into account, unless otherwise provided by the legislation of the Russian Federation.

58. A fee in the amount of 30 percent of the fee for conducting a primary state examination is charged for conducting a repeated state examination. In the event that documents for a repeated state examination in respect of residential capital construction projects are submitted within 14 days after receiving a negative opinion, no fee for conducting a repeated state examination is charged.
